As of October 1, 2024, a new law in England, Scotland, and Wales is set to transform the tipping landscape for restaurant workers.

The Employment (Allocation of Tips) Act 2023 prohibits businesses from withholding tips or service charges, ensuring that those who serve us receive the full gratitude of their patrons.

This legislation benefits over 2 million workers in the hospitality sector, with an estimated additional £200 million in tips expected annually.

All tips—whether in cash or added to a bill—must now be distributed among employees without deductions.

Restaurants are required to have a clear written policy on tip allocation, fostering trust and accountability.

A statutory Code of Practice will guide establishments on fair tip distribution, allowing flexibility based on roles and performance.

This means that not only servers but also kitchen staff and support roles can benefit from customer appreciation.

For restaurant owners, adapting to this law may require adjustments in financial management.

However, improved employee morale and retention can enhance the dining experience for customers.
